The Italian People Don't Know They've Lost Their
Sovereignty

Our Leftist coalition government hastily passed a Constitutional law
only a few
hours before Parliament was scheduled to close down in preparation for
general
elections last week. There are a few lines in this law that have not
been made
known to the people, either before or after the bill was voted into law.
They
are the revised version of article 117, which states that:
" Legislative power is wielded by the Government and by the
Regions of the
State, in observance of the Constitution as well as of the restrictions
that
derive from the Community organization and from international
obligations."
These three lines sanction Italy's loss of its sovereignty. That's why
article
117 has not been discussed openly: the Italian people must not be told.
The silence that has accompanied the building of the European Union
according to
its real purpose, i.e. putting an end to the independence of its member
countries, is a silence that has been willfully pursued by our own
rulers. They
know very well that the people would not accept it if they knew the
truth. But
although all the European leaders who planned the Union have agreed on
it, the
manner in which this strategy has been carried out in Italy is unique,
and
Italians must be allowed to have their say about it.
Let's read it once again, then: "legislative power is wielded by
the Government
and by the Regions of the State, in observance of the Constitution as
well as -
here comes the crucial point - the restrictions that derive from the
Communities' organization and from international obligations.
It's up to constitutional jurists to analyze this article in its
absolute
illegitimacy, but Italians have a right to know that they have lost
their
sovereignty. Neither the central government nor the regions can
legislate now,
except in subordination to "Community restrictions". These
ambiguous terms are
used because the European Community, which hands down these
restrictions, does
not exist in our Constitution. In all of the rest of the Constitution,
prior to
this reform, there wasn't even a mention of the term "Europe".
The "European
Community" and the enormous castle of the European Union, have
been built
outside of the Constitution, one treaty after another. (Maastricht,
Amsterdam,
Nice) Treaties are formally assigned to foreign policy precisely
in order to
avoid all obstacles. Further, because a specific norm of the
Constitution
subtracts foreign policy from citizens' scrutiny, it has been
possible to
withhold almost all information from the Italian people, thereby
preventing an
actual discussion from taking place.
It is on the basis of this cunning, this willed and bullying Trojan
horse, that
Italians have lost their independence little by little, without ever
being given
the chance to evaluate the consequences. Our leaders have blithely
signed a law
that decrees our subjugation to foreign powers, as has always been the
case in
our many centuries of history. The three lines of article 117 have been
introduced therefore in order to legitimize the loss of autonomy both
on the
part of the Regions and of the national government, by hiding it amidst
the din
caused by talk of conversion to a "federalist" state and of
the concessions to
local autonomy.
What sense does it make to mention "Community restrictions"
which are nowhere
named in the Constitution itself? Even a philologist, a historian
trained in
decrypting ancient texts, can point out the non-validity of a document
drawn up
this way.
Of course the ambiguity is there on purpose: no free country will ever
declare
of its own accord in its Constitution that it wants to depend on a
foreign
power, a power, moreover, which is not even established by or mentioned
in the
Constitution itself yet.
The leaders of Italy must take off their disguises now: who is it that
rules
over the Italian people now? And by the way, do the Italians WANT to be
governed
this way?
The other people in the Union have already been called or will be
called in the
near future to proclaim their will in this regard. The results of the
various
referendums, as we all know, have been almost completely negative. Now
at last,
for reasons different from the ones that regard the European
Union, Italians
will also be called up to speak their will in a referendum.
They had long been wishing for a greater freedom and local autonomy by
crying
out for a federalist reform. Now they find themselves grasping not
federalism,
but an enormous faceless nameless Super-State, all around, both on a
local and
on a national level.
Let's make haste to collect the necessary signatures. And let no one
cultivate
any illusions: "Roman" bureaucracy and corruption are nothing
compared to the
bureaucracy of France, Germany, Holland, Belgium, England, Italy,
Sweden.. all
put together. Take our President's word for it: in an interview
with
the Corriere della Sera he said: "our government has done away
with 300
regulations, but Brussels has sent us 3.000 more".

Gli Italiani non sanno d'aver perso la sovranità

Nella legge di riforma della Costituzione, approvata dalla maggioranza di sinistra in gran fretta poche ore prima dello scioglimento delle Camere, c'è un passo fondamentale e che pure non è stato portato a conoscenza dei cittadini né prima né dopo della sua approvazione. Si tratta dell'Articolo 117 di cui trascrivo il testo: " La potestà legislativa è esercitata dallo Stato e dalle Regioni nel rispetto della Costituzione, nonché dei vincoli derivanti dall'ordinamento comunitario e dagli obblighi internazionali". In queste tre righe è codificata la perdita della sovranità legislativa dell'Italia. Per questo l'articolo 117 non è stato discusso apertamente: gli italiani non debbono sapere.
Il silenzio che accompagna da anni la costruzione dell'Unione Europea nel suo vero scopo: la fine dell'indipendenza dei singoli Stati, è un silenzio perseguito coscientemente dai governanti perché sanno bene che i popoli non l'accetterebbero. Ma, sebbene ci sia stato l'accordo di tutti i governanti che hanno progettato l'Unione nel seguire questa strategia, il modo con il quale è stata messa in atto in Italia è unico, e spetta agli Italiani il giudizio su di esso. Dunque, rileggiamo: la potestà legislativa è esercitata dallo Stato e dalle Regioni nel rispetto della Costituzione, nonché - è qui che si nasconde il punto fondamentale - dei vincoli derivanti dall'ordinamento comunitario e dagli obblighi internazionali. Spetta ai costituzionalisti analizzare nella sua assoluta illegittimità questo articolo, ma gli Italiani hanno il diritto di sapere che hanno perso la sovranità. Sia Lo Stato che le Regioni non possono legiferare se non subordinatamente ai "vincoli comunitari", i quali vengono citati in questo modo ambiguo perché nella Costituzione la comunità europea, da cui discendono i vincoli, non esiste. In tutto il resto della Costituzione, infatti, prima dell'attuale riforma, non esisteva neanche il termine "Europa", così come la "comunità europea" e l'enorme castello dell'Unione Europea è stato edificato al di fuori della Costituzione, a colpi di Trattati (Maastricht, Amsterdam, Nizza) assegnati formalmente alla politica estera proprio per aggirare l'ostacolo. Inoltre è stato possibile così, dato che la politica estera è sottratta al giudizio dei cittadini con una norma specifica della Costituzione, informarne gli Italiani poco e male, impedendo una vera discussione in proposito.
E' in base a questa astuzia, a questo voluto e proditorio cavallo di Troia, che gli Italiani hanno perso a poco a poco, senza essere messi in grado di valutarne le conseguenze, la propria indipendenza, mentre i governanti firmavano a cuor leggero, come sempre è avvenuto nei tanti secoli di storia che abbiamo alle spalle, la sottomissione ai poteri stranieri. Le tre righe dell'articolo 117 sono state introdotte perciò, per legittimare, nascondendolo nel gran clamore del federalismo e delle concessioni fatte alle autonomie locali, la perdita di autonomia sia delle Regioni che dello Stato.
Che senso può avere, però, nell'ambito strettamente giuridico, il richiamo a vincoli comunitari che nella Costituzione stessa non sono nominati? Perfino un filologo, uno storico allenato a decrittare testi antichi, è in grado di mettere in luce l'invalidità sia formale che di contenuto di un documento stilato in questo modo. Inutile dire che l'ambiguità è voluta: non esiste infatti nessun Paese libero che dichiari per Costituzione di dipendere da un potere straniero, un potere, per giunta, ancora non costituito e non citato nella Costituzione stessa. I governanti italiani debbono adesso venire allo scoperto: chi è che comanda sugli Italiani? E gli italiani vogliono essere governati in questo modo? Gli altri popoli dell'Unione sono già stati chiamati o verranno chiamati nel prossimo futuro a proclamare la propria volontà in proposito. I risultati dei vari referendum sono stati, come è noto, quasi del tutto negativi. Adesso finalmente, per motivi diversi da quelli riguardanti l'Unione Europea, anche gli Italiani saranno chiamati ad esprimere la propria volontà con un referendum. Auspicavano da tanto tempo una maggiore libertà e autonomia locale invocando il federalismo. Si trovano invece, contestualmente al federalismo, a dipendere da un enorme Sovrastato, privo di volto e di nome, sia a livello locale che a livello nazionale.
Raccogliamole subito le firme necessarie. Nessuno di illuda: la burocrazia e la corruzione "romana" sono nulla in confronto a quelle francesi, tedesche, olandesi, belghe, inglesi, italiane, svedesi... tutte messe insieme. Parola del nostro Capo del Governo in una intervista al Corriere della Sera: "Bassanini ha tolto 300 norme e Bruxelles ne ha mandato 3.000".
